Summary of the general terms and conditions of DMF express s.r.o., effective from 5 October 2023. The binding version is the Slovak original.
The general terms and conditions (VOP) of DMF express s.r.o., Svätovavrinecká 13920/10, 831 01 Bratislava, Company ID (IČO) 55 071 724, registered in the Commercial Register of the District Court Bratislava III, section Sro, file No. 172153/B, are issued in Slovak under § 4 of Act No. 56/2012 Coll. on Road Transport. The legally binding version is the Slovak original. The summary below is provided for convenience only.
Key points
- Scope. The VOP govern all contracts, orders and implied contracts between DMF express and its customers. The customer’s own general terms apply only where DMF express has expressly agreed to them in writing. Matters not covered are governed by Slovak law, in particular the Commercial Code.
- Orders. Orders are placed in writing or electronically; urgent orders by phone must be confirmed in writing without delay. A contract is concluded when DMF express confirms the order in writing.
- Cancellation. If a confirmed order is cancelled less than 48 hours before delivery, a contractual penalty applies: 20 % of the price if notice is received more than 24 hours before the service, 50 % if received less than 24 hours before. Cancellations are accepted until 16:00; after that the next working day from 07:00 counts.
- Delivery. Delivery dates may be extended by the duration of force majeure (strikes, measures of public authorities, natural disasters). Visible defects must be reported in writing within 48 hours of the goods becoming available to the customer.
- Prices and payment. Prices are quoted excluding VAT. Late payment bears default interest of 18.25 % per year. Unilateral set-off by the customer is not permitted.
- Liability. Liability for damage is limited to the insurance cover for liability for goods or, where there is none, to the cost of repair; the limitation does not apply to intentional damage or gross negligence.
- Claims. Claims are submitted with photo documentation to info@dmfexpress.sk.
- Effective date. The VOP are binding from 5 October 2023.
